These Terms govern your access to and use of the Adefin website at adefin.be (the "Site") and any related services we offer through it, including the mailing-list signup form (the "Service"). By accessing the Site or using the Service, you agree to be bound by these Terms.

1. The operator

The Site and the Service are operated by:

2. Scope

These Terms apply to anyone who visits the Site or uses the Service. They do not constitute, and should not be read as, a contract for the provision of any financial product. Adefin does not currently offer financing, leasing or any other regulated financial service through the Site.

3. What the Service is, and what it is not

The Site is an information page about Adefin. The Service consists of:

  • Information about Adefin's planned product;
  • A signup form that lets you submit your email address to receive our messages.

Submitting the form does not entitle you to any service, product, financing decision, or commercial offer. It is a request to be informed.

4. Eligibility

To use the Service you must be at least 18 years of age and have the legal capacity to enter into binding agreements under the law applicable to you.

5. Acceptable use

You agree not to:

  • Submit an email address that is not yours or that you are not authorised to submit;
  • Use the Service to send unsolicited communications, spam, or malicious content;
  • Attempt to circumvent, disable, or interfere with security or rate-limiting features of the Site;
  • Use automated means (bots, scrapers) to interact with the Site without our prior written consent;
  • Use the Site or Service in violation of any applicable law.

We reserve the right to refuse or remove signups that we reasonably consider to breach these Terms.

6. Intellectual property

All content on the Site (including text, graphics, logos, the Adefin name, source code, illustrations, and overall design) is the property of Adefin or its licensors, and is protected by copyright, trade-mark and other intellectual-property laws. Nothing in these Terms transfers any right in that content to you. You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written consent, except for personal, non-commercial browsing.

7. Disclaimers

The Site is provided "as is" and "as available". To the maximum extent permitted by Belgian law, Adefin makes no warranties of any kind, express or implied, regarding the Site or the Service, including warranties of merchantability, fitness for a particular purpose, accuracy of information, or uninterrupted availability.

Information on the Site about future product features, launch timing, or commercial plans is forward-looking and may change at any time without notice. You should not rely on it as a binding commitment.

8. Limitation of liability

To the maximum extent permitted by Belgian law, Adefin and its founders, employees and contractors shall not be liable for any indirect, incidental, consequential, special or punitive damages arising out of or relating to your use of, or inability to use, the Site or the Service, including loss of data or loss of business opportunity.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under Belgian law, including liability for fraud, intentional wrongdoing, or death and personal injury caused by negligence.

9. External links

The Site may contain links to third-party websites or resources. We provide such links for convenience only. We do not control, endorse or accept responsibility for the content, products or services of any third-party site. Accessing them is at your own risk and subject to those third parties' own terms.

10. Personal data

Our handling of personal data submitted through the Site is described in our Privacy statement, which forms an integral part of these Terms.

11. Changes to the Site and to these Terms

We may modify or discontinue all or part of the Site or the Service at any time, with or without notice. We may also update these Terms from time to time. The version in force is the one published on this page; we will indicate the date of the latest update at the top. Material changes will, where practical, be brought to the attention of subscribers by email.

12. Governing law and jurisdiction

These Terms are governed exclusively by Belgian law. Any dispute arising out of or in connection with the Site, the Service or these Terms shall be brought before the competent courts of Brussels (Dutch- or French-speaking division, as applicable), without prejudice to any mandatory consumer-protection rules granting you the right to bring proceedings before the courts of your domicile.

13. Severability

If any provision of these Terms is held to be invalid, illegal or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that comes closest to the parties' original intent.
